- Our liability is limited to what you paid for the project in the last 12 months.
01
About these terms
These terms apply when you use cretasystem.com and when you work with Creta Systems (“Creta”, “we”, “us”). By using the website, you agree to them. If you don’t agree, please don’t use the site.
“You” means the person using the site or, when you act for a business, that business. How we handle personal data is covered separately in our privacy policy.
02
Using our website
You are welcome to browse, read and share links to the site. When you do, please don’t:
- break the law, or help anyone else to;
- try to gain unauthorised access to the site, its servers or any connected system;
- upload or send malware, or anything that could damage or overload the site;
- scrape, copy or reuse the site’s content or code at scale without our written permission;
- pretend to be Creta Systems or suggest that we endorse you when we don’t.
We may change, pause or withdraw any part of the site at any time. We aim to keep it available, but we can’t promise it will always be uninterrupted or error-free.
03
Our content and brand
The website’s design, text, graphics, animations and code, and the name and logo “Creta”, belong to Creta Systems or our licensors. You may view them for personal or internal business use. Anything else, such as copying, adapting or publishing them, needs our written permission. Client names, project names and trademarks shown on the site belong to their owners and appear with permission.
04
Information on the site
Content on the site, including project descriptions and figures, is general information about our work. It isn’t professional advice, and it isn’t an offer we are bound to. A project only starts once we both agree a written proposal or contract.
05
Working with us
Every project is set out in a written proposal, statement of work or contract (the “agreement”). If the agreement says something different from these terms, the agreement wins. Where it is silent, the following applies.
Proposals and scope
Proposals are valid for 30 days. The agreed scope is what we will deliver. Changes to it are welcome, and we will confirm any effect on cost or timeline in writing before we start them.
Your part
Projects run on time when we get timely feedback, content, approvals and access to the systems we need. You confirm that you have the right to give us any material you supply, such as text, images, data or brand assets, and that we may use it for the project.
Fees and payment
Fees and payment milestones are set in the agreement. Invoices are due within 14 days. If an invoice is overdue, we may pause work after giving you written notice.
Ownership of the work
Once you have paid in full, you own the final deliverables we create specifically for you. We keep ownership of our pre-existing tools, code libraries, components and know-how, and give you a permanent licence to use any of them included in your deliverables. Open-source software stays under its own licence.
Portfolio
We may show completed work in our portfolio and marketing, unless you ask us not to in writing or the agreement says otherwise. We never share your confidential information this way.
Confidentiality
We both keep each other’s confidential information private and use it only for the project. This continues after the project ends.
Third-party services
Many projects rely on services run by others, such as hosting, app stores, payment providers, APIs and AI models. Their own terms and pricing apply, and we aren’t responsible for their outages or changes, though we will help you work around them.
After launch
Support, maintenance and warranty periods are set in the agreement. We fix defects in our own work that are reported within the agreed warranty period at no extra cost.
06
Our products
Products built and run by Creta Systems, such as Hoopoe, have their own terms of use. Those terms, not these, apply when you use a product.
07
Links to other websites
The site links to client projects and other websites that we don’t control. We aren’t responsible for their content, availability or how they handle your data.
08
Disclaimer
The website is provided “as is”. As far as the law allows, we give no promises or warranties about it beyond those set out in these terms.
09
Limits on our liability
As far as the law allows:
- we aren’t liable for indirect or consequential loss, or for lost profit, revenue, data or goodwill;
- our total liability for a project is limited to the fees you paid us for that project in the 12 months before the claim;
- the website is free to use, and we aren’t liable for loss arising from using it.
Nothing in these terms limits liability that can’t legally be limited, such as liability for fraud or for death or personal injury caused by negligence.
10
Your responsibility
If you misuse the site, or give us material that infringes someone else’s rights, you are responsible for the claims and costs that result.
11
Ending a project
Either of us may end a project as set out in the agreement. If the agreement doesn’t say, either of us may end it with 14 days’ written notice. You pay for work done up to that date, and we hand over the work you have paid for.
12
Governing law and disputes
These terms are governed by the laws of Pakistan. If something goes wrong, tell us first. We will try to settle it in good faith within 30 days. If we can’t, the courts of Pakistan will decide, unless the agreement names another place. If you are a consumer, you keep any protections the law of your country gives you.
13
Changes to these terms
We may update these terms from time to time and will show the new date at the top of this page. The version in force when you use the site applies. Changes don’t affect an agreement we have already signed with you.
14
General
- If a court finds part of these terms invalid, the rest still applies.
- If we don’t enforce a right straight away, we can still enforce it later.
- You may not transfer your rights under these terms without our written consent.
- Questions about these terms go to info@cretasystem.com or 0336 8957401.
